Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and other who access or use the Service. By accessing or using the Service you hereby acknowledge and agree to be bound by the following Terms and Conditions and any future amendments and additions to these Terms and Conditions as published from time to time. If you disagree with any part of the Terms, then you may not access the Service.

DEFINITIONS

“Terms” means the general terms and conditions set out here in respect of the HurryPOST SG online and offline platform services.

“HurryPOST SG”, “we”, “us”, and or “our” refer to HurryPOST SG Pte. Ltd.

“HurryPOST Staff” refers to the employees recruited by HurryPOST SG including, but not limit to the HurryPOST SG’s Management.

“Service” means the all services offer by HurryPOST SG.

“Platform” refers to http://www.hurrypost.com website and other software provided by HurryPOST SG from time to time.

“Airwaybill” refers to the consignment note for online and offline Delivery Request.

“Client” means a business entity or individual seeking Delivery Service provided by HurryPOST SG.

“Sender” means a person and/or entity who makes a Delivery Request by inputting the Delivery Information onto the Platform and the Airwaybill and pays HurryPOST SG for the Delivery Request.

“You”, “your” and or “yourself” refer to Client and Sender as define above.

“Requestor” refers to the person who raises the Delivery Request.

“Recipient” refers a person and/or entity whose name and details are provided by the Sender as the person and/or entity who the delivery item shall be delivered to.

“Delivery Item” refers to type of consignment such as document, parcel or others excluded items fall under Refusal of Shipment that defined under Clause 4.

“Document” refers to document paper that is at A4 size not exceeding 40cm x 30cm x 4.5cm and total of document weight maximum at 2kg and below.

“Parcel” refers to Delivery Item that is with the weight or dimension weight at 2kg and above.

“Delivery Request” refers to the request for the delivery of one or more delivery items requested by the Client to be collected from one address (Pickup Address) and delivered to another address (Delivery Address). When there are multiple Pickup and/or Delivery Addresses, HurryPOST SG will consider them as multiple Delivery Request.

“Delivery Service” means all the services that HurryPOST SG, directly or indirectly, provide to you in relation to the delivery items.

“Delivery Information” refers all data required by HurryPOST SG to confirm a Delivery Request, which will include some or all of the following:
  • Pickup Address (full address, including company name, street name, building and unit numbers, postal code, and any other relevant instructions).
  • Sender’s name, email and telephone details (preferably a contact that can be reached while the delivery is taking place).
  • Where different from Sender, the name, email and telephone details of the person who will be handing the Delivery to the HurryPOST Staff at the Pickup Address.
  • Receiver Address (full address, including company name, street name, building and unit numbers, postal code, and any other relevant instructions).
  • The Recipient’s name, email and telephone details (mobile preferable).
  • Type of Consignment covers the type of delivery item such as Document, Parcel and or Other.
  • The contents of delivery item.
  • Quantity of delivery item.
  • Dimension(s) of delivery item.
  • Weight(s) of delivery item.
  • Value of Item(s) of delivery item.
  • Delivery Packages that the Sender would like to engage the Service with HurryPOST SG.

“Courier Fees” means the price quoted to you before you confirm a Delivery Request. This is the amount payable by you for engaging our Delivery Service in relation to a particular Delivery Request.

“Delivery Packages” refer to four different delivery package offers by HurryPOST SG.
  • 3 Hours: Cut off for receiving delivery request at 2:00pm. Delivery Item will arrive at destination before 5:00pm.
  • Same Day: Cut off for receiving delivery request by 11:00am. Delivery Item will arrive at destination before 5:00pm. Same Day delivery raised after 11:00am will be consider as 3 Hours Package.
  • Next Days: Cut off for receiving delivery request by 4:00pm. Delivery Item will arrive at destination on the next day before 5:00pm. Order received after 4:00pm for Next Day delivery package will be consider as Same Day delivery package for following day
  • Others: Delivery packages that do not fall into neither three packages as stated above. Customize delivery service will be arranged as required.

“Please specify” refer to any special instruction or precaution to be taken in respect of the Delivery Request as stated in the Airwaybill.

“Courier Bag” refers to the seal bag provided by HurryPOST SG.

“Completion of Delivery Procedures” refers to one of the methods in which a delivery can be completed. This method requires the Recipient or person receiving the Parcel on behalf of the Recipient to provide his/her name and the National Registration Identity Card (NRIC).

1. DELIVERY SPECIFICATIONS
1.1. Sender must to fill in the Delivery Information on the Airwaybill provided HurryPOST SG. It is sender’s responsibility to check the Delivery Information is correct and accurate.

1.2. Sender must use the Courier Bag provided by HurryPOST SG as the most outer packing as appropriate. The Courier Bag is design to pack for Delivery Item such as A4 size document paper and or other item as descript by sender at the maximum weight of 2kg and below. Sender shall ensure that all the Delivery Item is correctly packed into Courier Bag. It is not our responsibility to check the completeness of the Delivery Item during pickup.

1.3. The affordable Parcel size is 30cm(L) x 30cm(H) x 30cm(W) for motorcycle to transport the Parcel. In the event the Parcel size is bigger than the size as mentioned above, the Sender is required to make contact with HurryPOST Staff for appropriate transportation.

1.4. In the event if the Courier Bag does not fit in the size of the Delivery Item, sender shall ensure the Delivery Item is packed in a case, wrapper or container appropriate to all the nature and weight of the Delivery Item such that no part of the Delivery Item may be removed without the case, wrapper or container being torn or broken or a seal being broken or two adhesive surfaces being forced part.

1.5. In the event that packing of the Delivery Item is deemed by HurryPOST SG to be unsuitable for transportation, you shall, upon notification by HurryPOST SG, re-pack the Delivery Item in a suitable case, wrapper, container or Courier Bag. If Client insist HurryPOST SG to proceed with the Delivery Service without re-pack the Delivery Item in a suitable case, wrapper, container or Courier Bag, any losses of the items and exposure of information that may contain in the document shall not be liable under HurryPOST SG.

1.6. Sender shall ensure that the Delivery Item is adequately packed so as to protect against damage to the Delivery Item during the course of delivery. In the case when:
a) Delivery Item is fragile in nature, the Delivery Item shall be packed in a case or container of sufficient durability and strength and shall be encased in or surrounded by sufficient and suitable protective material inside that case or container such that the Delivery Item is guarded against damage that my result from any force, pressure or blows to which postal item are ordinarily subject during the course of delivery and that such Delivery Item shall bear the words “FRAGILE” prominently displayed in capital letters on the face of the case or container or Courier Bag and on the "Please Specify" Column.

b) Delivery Item which is susceptible to damage by bending, the Delivery Item shall be packed in a case or container of sufficient durability and strength to prevent the Delivery Item from being bent or otherwise damaged during the course of delivery and such case or container shall bear the works “DO NOT BEND” prominently displayed in capital letters on the face of the case or container or Courier Bag and on the "Please Specify" Column.

1.7. Sender shall determine the type of consignment is selected as appropriate as part of the Delivery Information to fill in the Airwaybill.

2. CUSTOMER’S OBLIGATION
2.1. All Delivery Request must comply with our Delivery Specifications. If a Delivery Request does not comply with our Delivery Specifications, then we may decline to your Delivery Request. We may also terminate or suspend your account with us and charge you for our associated costs of this. You hereby agree to indemnify us for all costs incurred as a result of any non-compliance with our Delivery Specifications. In the case that a Delivery Request is non-compliant for reasons beyond your control, such as a fault in our Platform, you will not be liable for costs incurred as a result of the non-compliance.

2.2. When creating a Delivery Request, you must provide the necessary Delivery Information to HurryPOST SG via our Platform or in the Airwaybill we have provided. If you are making a Delivery Request on behalf of someone else, you are obliged to have obtained the consent of that person to provide his/her information to us. This clause shall in no way limit the generality of Clause 5.1.

2.3. We shall use the Delivery Information to process your Delivery Request, including, but not limited to, generating a list of Delivery Request which can be viewed by our backend operation staff. The Delivery Information will also be processed in order for us to provide you with the Courier Fees.

2.4. We will confirm your order by email and or call after you have raise your Delivery Request. The confirmation of the Delivery Request signifies our acceptance of your Delivery Request.

2.5. HurryPOST SG will not accept liability for damage or breakage caused by poor packing, which contravenes to Clause 1 requirements. Further, HurryPOST SG will not accept Items which in the opinion of the HurryPOST Staff are inappropriately packed, or disparate loose unpacked Items. Delivery Request on this basis will be further follow up by Clause 1.4.

2.6. HurryPOST SG may at any time inspect your Delivery Item and refuse to complete a delivery if we consider that it breaches Clause 4.

2.7. The Delivery Request will be completed by requesting the Recipient to perform the “Completion of Delivery Procedures”. The Sender is responsible to ensure that the Recipient or person acting on behalf of the Recipient agrees to provide our HurryPOST Staff with the information as requested in the “Completion of Delivery Procedures”. In the event where the Recipient or person acting on behalf of the Recipient refuses to provide our HurryPOST Staff with the necessary information, the Delivery Item will be returned to the Sender and no refund of the Courier Fees will be available.

2. CUSTOMER’S OBLIGATION (CONTINUED)
2.8. A Delivery Request is deemed completed once HurryPOST SG is in receipt of the information as required under the “Completion of Delivery Procedures”. An Automated email notification will send to your registered email address after the delivery is completed.

2.9. The Delivery Item will be delivered to the specified Recipient Delivery Address in the Delivery Information, but not necessarily to the named Recipient personally. Nonetheless, the person that received the Delivery Item on behalf will required to provide the full name and Identification number as required under the “Completion of Delivery Procedures”.

2.10. The Sender and the Recipient will be able to track the delivery status on HurryPOST SG’s Platform until the delivery is completed. You should keep track of what items are inside each Parcel.

2.11. If you have a complaint in relation to the delivery of the Delivery Item, you may contact HurryPOST SG’s customer service to raise such dispute. HurryPOST SG may, where appropriate, disclose proof of delivery (which may include information collected through the “Completion of Delivery Procedures”) to you and/or all parties related to the dispute, until the dispute is settled.

2.12. You shall state on the Delivery Information on the Airwaybill provided by HurryPOST SG in respect of each Delivery Item all the information including without limitation:
a) Pick up address (including the postal code), name of person to collect the delivery item, company, telephone number and email;
b) Receiver address (including the postal code), name of recipient, company, telephone number and email address;
c) Type of consignment with contents, quantity, declared value, dimension and weight;
d) Delivery Packages with specify of special arrangement/precautions;

3. HURRYPOST SG’S RIGHT TO INSPECT CONTENTS
3.1. HurryPOST SG may, at any time, in its absolute and sole discretion, open and inspect the contents of the Delivery Item for any reason whatsoever including without limitation the verification of the contents of the Delivery Item. If upon such opening and inspection, the description and declaration of the contents of the Delivery Item is verified as being incorrect or misleading, HurryPOST SG shall charge to you the shipment charges applicable to the contents discovered.

4. REFUSAL OF SHIPMENTS
4.1. You hereby agree and acknowledge that HurryPOST SG may decline to deliver any item where:
  1. The application for delivery does not comply with the Terms and Conditions stipulated herein;
  2. You fail to accurately describe and declare the contents of the Delivery Item;
  3. The packing of the Delivery Item is deemed unacceptable for delivery as per Clause 1.4;
  4. Delivery is prevented, impeded or otherwise made unsafe or difficult by reason of unforeseen events such an act of God or event of force majeure; or
  5. You request any change to the scope of the HurryPOST SG Service to which HurryPOST SG does not agree to in writing;
  6. HurryPOST SG is of the opinion that it is unable to deliver any item safely or legally including without limitation the following items;
    1. Explosives, firearms or other offensive weapons, flammable or hazardous materials, poisonous or infectious substances, blood or blood products (whether infectious or not), dangerous or undesirable goods and all items prohibited by the International Air Transport Association, the International Civil Aviation Organization or any relevant government authority or under any applicable law or regulation;
    2. Human or animal remains, memorial tablets or any items for use in religious ceremonies;
    3. Live animals;
    4. Credit cards, debit cards or cash cards;
    5. Currency, cheques, bills or any bearer form negotiable instruments;
    6. Share certificates or other documents evidencing title to securities;
    7. Personal documents issued by government authorities such as identification cards, passports, driver’s licenses, birth certificates etc.;
    8. Original copies of any record, drawing, document or electronic recording of which duplicates or copies have not been made and kept by you;
    9. Documents containing a substantial amount of confidential information;
    10. Precious metals and stones;
    11. Illegal narcotics or drugs; or
    12. Any Delivery Item (or its contents thereof) of a value exceeding SGD500. Compensation is limited to Clause 11.6; responsibility fall under sender to have additional insurance coverage on any loss and or damage.
4.2. In the event that HurryPOST SG discovers during the course of delivery that a Delivery Item consists of any goods, items, products or materials referred to in Clause 4(f)(i), (ii) or (iii) as above, HurryPOST SG reserves the right to dispose of the Delivery Item forthwith and shall notify you of the disposal within a reasonable period from the disposal. You shall bear any costs incurred or charges imposed by HurryPOST SG in connection with such disposal.

5. PROHIBITIONS
5.1. Use of the Platform/ Engagement of our Delivery Service:
  1. You shall only use the Platform and/or our Delivery Service for lawful purposes.
  2. You shall not contact HurryPOST Staff for purposes other than the Delivery Service.
  3. You shall not use the Platform for sending or storing any unlawful material or for fraudulent purposes.
  4. You shall not use the Platform to cause nuisance, annoyance, and inconvenience or make fake Delivery Request.
  5. You shall not use the Platform for any purpose, which may reasonably be said to harm the Platform in any way whatsoever.
  6. You shall not copy, or distribute the Platform or contents on the Platform to any persons without prior written permission from HurryPOST SG.
  7. You shall not employ any means to defraud HurryPOST SG or enrich yourself, through any means, whether fraudulent or otherwise, whether or not through any event, promotion or campaign launched by HurryPOST SG to encourage new subscription or usage of the Platform by new or existing Clients.
  8. You shall not impersonate any person or entity or otherwise misrepresent your affiliation with a person or entity when providing details of your identity to HurryPOST SG.
  9. You shall not, without the consent of an individual and/or entity, provide any information to us, including, but not limited to, personal information. For the avoidance of doubt, personal information has the same meaning as Personal Data defined in our Privacy Policy.

5.2. Use of Information: You shall not collect, use or disclose any information provided to you by HurryPOST SG, either through the Platform or any other formats, for purposes other than the Delivery Service

6. CANCELLATIONS AND MODIFICATIONS OF DELIVERY REQUEST
6.1. Cancellation Fees: Any cancellation of the delivery will not be refunded once the Delivery Request submitted and confirmed by HurryPOST SG, is the Requestor responsibility to double confirm before submit the Delivery Request to HurryPOST SG.

6.2. Modification of a Delivery Request: If you would like to modify a Delivery Request, we will make reasonable efforts to assist you. In the event that a HurryPOST Staff is no longer available or cannot complete the modified Delivery Request, we will reject the modification of the Delivery Request. In this case, Client can opt to complete the original Delivery Request, or cancel the Delivery Request (cancellation fee may apply as per Clause 6.1 above).

6.3. Cancellation by HurryPOST SG: HurryPOST SG reserves the right to cancel a Delivery Request. Where HurryPOST SG cancels a Delivery Request, other than where necessitated by fault of the Sender or the Recipient, HurryPOST SG will refund you the full amount of the Courier Fees.

7. COURIER FEES AND ADDITIONAL FEES
7.1. The Courier Fees will be quoted to the Client before a Delivery Request is accepted. By making and confirming the Delivery Request, you accept to pay the quoted Courier Fees. HurryPOST SG reserves the right to amend the fees if we found out that the information provided when fees quoted is different to physical item when collect by our HurryPOST Staff.

7.2. Waiting Time: HurryPOST Staff will wait for a maximum of 10 minutes at both the Pickup Address and Delivery Address unless instructed otherwise by you or HurryPOST SG as appropriate. The first 10 minutes of waiting at either location are free of charge. Additional waiting time is quoted at SGD 0.50 per minute. HurryPOST SG’s customer service will attempt to contact the Sender by telephone for authorization to incur additional, chargeable wait time if necessary. In the event where the Sender cannot be contacted, the Sender hereby authorizes HurryPOST SG to incur additional, chargeable wait time on the Sender’s behalf as HurryPOST SG deems appropriate.

7.3. Additional Fees due to inaccurate Delivery Information: You recognize that HurryPOST SG’s ability to provide the Delivery Service is dependent on the accuracy of the Delivery Information. You acknowledge that HurryPOST SG shall not be liable for any breach of these Terms and Conditions caused by any inaccuracy in such information, and that you will be liable to pay for any additional charges arising as a result of such inaccurate data.

7.4. Payment of Additional Fees: You accept that the Courier Fees and any incurred additional fee will be charged to the payment method chosen by you when confirming the Delivery Request.

8. FAILURE TO COMPLETE A DELIVERY
8.1. Redelivery: In the event where a delivery is not completed because HurryPOST Staff was late to reach the Recipient for reasons that are not the Client’s responsibility as per Clause 4 and Clause 6.2, and not described under force majeure, HurryPOST SG’s customer service will contact you to arrange for a redelivery, free of charge.

8.2. Recipient absent: In the event that the Recipient is found to be absent from the Delivery Address specified by the Sender and no other person is present to receive the Delivery Item on behalf of the Recipient, HurryPOST Staff will call the Sender to request further instructions on how to proceed. In the event where the Sender cannot be contacted either; the Sender hereby authorizes HurryPOST SG to decide on the Sender’s behalf as we deem appropriate. You acknowledge that additional charges may arise as a result of the failure to complete the delivery due to missing Recipient (e.g. Cancellation fee and Additional waiting time as per Clause 6.1 and Clause 7.2 above, and/or charges in relation to the making of a new Delivery Request).

9. REFUNDS
9.1. Upon your disagreement against Clause 1.4 due to inappropriate of packing Delivery Item, the Delivery Request will be rejected and will not be eligible for refund.

9.2. No refund of unsuccessful Delivery Request as per stated in Clause 2.7.

9.3. Unless cancellation is initiated by HurryPOST SG as per Clause 6.3, HurryPOST SG does not automatically offer refunds for service delay or failures, but decides on any possible refund on a case by case basis following a review of the circumstances. All requests for refunds should be addressed to HurryPOST SG’s customer service manager at +65 6291 0540, who will authorize refunds at her/his discretion. Refunds may be partial or total depending on the severity of the failure and the inconvenience caused. Refunds will be made to the same source of payment used to make payment for the Delivery Request.

10. OUTSOURCING TRANSPORTATION
10.1. HurryPOST SG has the right to enter into any sub-contract for performance of its obligations hereunder without prior notification to you provided always that HurryPOST SG shall remain at all times primarily responsible to you for its obligations.

11. LIABILITY
11.1. HurryPOST SG shall not be liable for loss or damage arising from or in connection with:
  1. The delivery of any of the articles set out in Clause 4 (where HurryPOST SG was not aware that the contents of a Delivery Item comprised or included such articles);
  2. Your failure to specify any special precautions to be taken in respect of a Delivery Item, as required to provide as part of the Delivery Information and Clause 1, on the Airwaybill;
  3. The misalignment, wear and tear, de-arrangement, heat, mold, rot, dis-coloration, degeneration, explosion, ignition or the hazardous, perishable, corruptible, fragile, or brittle nature of the contents of the Delivery Item;
  4. Delay or confiscation by any government authority due to the discovery of prohibited contents of the Delivery Item;
  5. HurryPOST SG’s failure to perform any of its obligations hereunder as a consequence of circumstances outside its control, including without limitation any act of God such as weather conditions, flood or earthquake, work stoppages, strikes, industrial disputes, war, any act of government, accidents, traffic obstructions or congestion, mechanical breakdown, or other events of force majeure; or
  6. Any acts or omissions of any party other than HurryPOST SG, including without limitation you, the named addressee, any government official or any sub-contractor engaged by HurryPOST SG (whether or not you had notice of any arrangement between HurryPOST SG or such sub-contractor).
  7. The Delivery Item that are not in conformation with these Terms and Conditions;
  8. Any loss caused directly or indirectly by any breach by the Client of these Terms and Conditions including, but not limited to, the Delivery Specifications;
  9. Delivery Item that need special transportation precaution and no specification were mentioned in relation to the said Parcels and/or Items in the Delivery Information;
  10. Inherent defect or natural deterioration of the Delivery Item;
  11. The collection and/or signing off of the Delivery Item by a person, who, unbeknownst to HurryPOST Staff, is not authorised to do so by the Recipient.
11.2. HurryPOST SG shall not be responsible or liable for any loss of or damage to the Delivery Item once the delivery is completed.

11.3. HurryPOST SG shall not be liable for indirect or consequential loss or damage, including without limitation loss of profit, income, interest, future business or anticipated savings, even if the risk of such loss or damage was brought to HurryPOST SG’s attention before or after acceptance of the Delivery Item.

11.4. HurryPOST SG shall not be liable for delay or non-delivery of a Delivery Item arising from or in connection with the detention of the Delivery Item by any government authority.

11.5. For the avoidance of doubt, HurryPOST SG shall not in any way be liable or responsible for a Delivery Item prior to the Delivery Item being accepted by HurryPOST SG for delivery.

11.6. Total Liability is subject to Clause 7.3 and Clause 11, HurryPOST SG’s total liability in relation to the Delivery Service (whether the liability arises because of breach of contract, negligence or for any other reason) shall be limited for damage to or loss of the Delivery Items at SGD 150 per 2-3 Hours Delivery Request, SGD 100 per Same Day Delivery Request and SGD 50 per Next-Day Delivery Request and, or the value of Delivery Item transported under that Delivery Request, whatever is lower. The compensation will be subject to the Deliver Packages selected in the Delivery Request.

12. INDEMNIFICATION
12.1. You shall defend, indemnify and hold HurryPOST SG and its affiliates and employees harmless from and against any and all claims, costs, damages, losses, liabilities and expenses arising out of or in connection with:
a) Your violation or breach of any provision under these Terms & Conditions or any applicable law or regulation;
b) Your violation of any rights of any third party and your use or misuse of the Platform.

13. TERMINATION AND ADMENDMENT
13.1. HurryPOST SG may, and at any time, and at our sole discretion, modify these Terms and Conditions of Use, including our Privacy Policy, with or without notice to the User. Any such modification will be effective immediately upon public posting. Your continued use of our Service and this Site following any such modification constitutes your acceptance of these modified Terms. We reserve the right to terminate any account for late payment of charges

14. GOVERNING LAW
14.1. The Terms and Conditions set out herein shall be subject to and construed in accordance with the law of Singapore. The parties hereby irrevocably submit to the exclusive jurisdiction of the courts of Singapore and agree that all proceedings in relation to any dispute arising out of or in connection with these Terms and Conditions shall be commenced in the courts of Singapore.

15. PERSONAL DATA PROTECTION
15.1. The Privacy Policy is hereby incorporated into these Terms & Conditions and forms part of the contract between you and HurryPOST SG.

15.2. You agree to provide accurate, current and complete information to us and undertake the responsibility to maintain and update your information in a timely manner to keep it accurate, current and complete at all times during the term of these Terms & Conditions. You agree that HurryPOST SG may rely on your information as accurate, current and complete. You acknowledge that if your information is untrue, inaccurate, not current or incomplete in any respect, HurryPOST SG has the right to terminate your relationship with us and block your access and use of the Platform at any time without prior notice.

16. SEVERABILITY
16.1. If any provision of these Terms and Conditions is declared or found by the courts of Singapore to be illegal, unenforceable, or void, then such provision shall be null and void, but each other provision hereof not so affected shall be enforced to the full extent permitted by applicable law.
